Udupi: Akku-Leela episode; non-adherence of Supreme Court order by state Govt; release of only 5 years salary on fear of court punishment

Udupi;Dec 10: Addressing the press reporters in the press meet held in Udupi Vaikunts Baliga law college on Dec 09,Monday,Dr Ravindranath Shanbhag,president of human rights protective foundation said in his address that in case of Akku-Leela case, who have been serving for the last 42 years with meager salary of Rs 15 per month, though  four years have been rolled out  after supreme court has passed an order in this connection, the state government has not yet implemented the order and  the situation has reached to the extent of facing court abuse punishment.

He further said that it is understood from reliable source that some conspiracy by the state government is being going on to escape from the court abuse punishment to give 5 years’ of salary instead of 42 years to Akku and Leela.

The background of the episode: Kinnimulky Akku and Chitpady Leelavathi have joined Udupi government girl’s training centre managed by state education department for mere Rs 15 per month as their basic salary as cleaning staff in 1971.Thereafter they submitted their request to the concerned authorities to make them permanent employees and to give full salary but all their efforts were gone in vain.

But in 1984, though there was a clear cut court order to make all the temporary employees to make permanent staff, those who have served more than 10 years, it is unfortunate that in case of Akku and Leela, their pleas have been rejected.

In this regard Akku and Leela, in 1998 under the guidance of human rights protective foundation lodged a complaint with Karnataka management of justice mandali.That why, education department has terminated their service. Even after their termination, they continued their service without receiving salary. Now they have retired from their service in 2011.

In between in 2003, in this case administration of justice in its verdict asked the state government to make these two employees permanent and pay full salary as others in 1971.Questioning this order, state government has filed a legal suit in high court. Rejecting state government’s contention, high court has clearly ordered state government to follow the orders of management of justice mandali in 2004.

Thereafter state government has taken this case to Supreme Court, there also it had to face humiliation. Supreme Court in its final verdict in the year 2010 January asked the state government to make Akku and Leelavathi a permanent employees and to make full payment retrospective from 1971.

Abusive of court order: Udupi human rights protective foundation has filed a’Abuse of court order’ legal suit in supreme court in last June, against the state government, which has not followed supreme court order for the last four years.

Since the Supreme Court failed to meet the deadline date of September-October for the judgment, the human rights protective foundation has given final warning. Since the authorities came to know about the possible arrest of secretary of education department and related officers, is expected any time, now authorities concerned have got up from their sleep.

Now S.B.Patagar, dependent secretary has passed an order to give Rs 2, 21, 296 to Akku and Rs 2, 21,396 to Leela from 1998 to 2003 March based on their basic salary. But authorities have not bothered to take any action about making permanent of earlier services rendered by them. Department instead of giving salary for the last 42 years, which is amounting Rs 27 lac,has come forward to pay only for five years. The foundation has decided to bring this matter to the attention of supreme court, informed Dr.Ravindranatha Shanbhaug.

 In the state more than 750 Akku-Leela!!:

The human rights protective foundation has received informations about there are more than 750 employees who have been serving as cleaning staff just for Rs 15 per month for the last 42 years similar to AKKU-LEELA.

In this, Malpe government’s P.U Degree College’s Padma, who is still working and Mangalore’s Elizabeth have been included. They are all in the expectation of receiving full salary. Most of the people in the list have been retired—As per Dr.Ravindranatha Shanbhaug.

‘Husband is sick and at home. Out of two sons, one is working as painter and other son is doing Pigmy collection. Out of three daughters, one daughter has got married and two daughters are yet to be getting married. We don’t want any other extra money other than our eligible money for the service we have rendered for the last 42 years-says AKKU

My husband, who was working as sweeper in Manipal has been retired and going for cooly works.I am managing my house with great difficulties with three grown up daughters. We must receive our hard earned money, whatever due to us and this will help my three daughters-says LEELA
