Builders asked to pay compensation; observed deviation from contract terms

Mangalore, May 29: It has came to light the irregularities committed by builder that when residents,  approached Dakshina Kannada consumer disputes redressal forum revealed that  Mumbai based Sequira Star Home builders failed to provide them the amenities as they promised in the agreement.

Residents of the apartment at Kadri Tollgate in the city asked the builder and promoter to pay compensation for deviating from the providing ameneties, which they have promised while booking the flats.

Sources said case was registered under section 12 of the consumer protection Act 1986 alleging deviation from building license terms, which was illegal, such as extension of the floor area, incomplete compound wallo,insufficient parking facility, poor quality cabling and electrical fittings, absence of intercom facility, poor flooring, concrete door frames instead of wooden door frames, gymnasium facility etc.

Asha shetty, president of the forum observed that Mr. Felix Sequeira has not adhered to norms and conditions of building contruction act and failure to provide the legal documents to the residents and had deviated from the approved building plan and also violated the licensing terms and condition. She had also noted that there was considerable delay in standardizing the illegal construction.

She also added that apart from setting the defects right, the builder has been asked to pay Rs 50,000/=each towards the damages and in case of failure to issue a completion certificate within the   stipulated time of three months, the builder has to Pay Rs 500/per day to the residents of the apartment until the date of issuance of certificate with permanent door number. Further double tax collected by the MCC must be borne by the builders till they set the said problem right, also asked to pay Rs 4000/-each which includes commissioner’s fee within 30 days from the date of order.
