Mangaluru, December 13: The state high court (HC) has directed Dakshina Kannada district deputy commissioner to bulldoze a building constructed by former zilla panchayat president, Sucharita Shetty, in Kadandale village in Mangaluru taluk.
A petition was filed in the court by Shanta Shetty who owns land at Kadandale village, alleging that Sucharita Shetty had constructed an RCC building in a agricultural land owned by her in that village.
The court which heard the case learnt that Sucharita Shetty had constructed an RCC building illegally in the said agricultural land without obtaining prior permission as from the panchayat development officer. The court has ordered to evict people from building in litigation and raze the building. It has also instructed to collect fine for constructing a building by violating rules.
Court also directed the DC to take actions against extension officer of the taluk, and Paladka gram panchayat development officer, Rajendra Prasad Shetty, for failing to take action to stop illegal construction of building by Sucharita Shetty in the agricultural land. The court noted that these officials were aware of the fact that this building was coming up in agricultural land violating Karnataka Land Reforms Act, and hence their failure to initiate actions amounts to dereliction of duty.
Sucharita Shetty had taken initiatives to structure a building in an agricultural land owned by Shanta Shetty in Kadandale village. Sucharita Shetty had argued that he holds a share in the said property.
Shanta Shetty had filed a case against Sucharita Shetty in a subordinate court, but during this period, the construction work of the building construction was over.
Distressed by it, Shanta Shetty had approached the High Court seeking demolition of this building. In addition to passing order for the demolition of the building, the High court also instructed the subordinate court that prior to February-2015, it has to dispose the pending civil case.
