Thane: Man gets 25-month jail in assault case

A 24-year-old man was convicted and sentenced to 25-month imprisonment by a local court for assaulting a labourer in Bhiwandi in Thane in 2012.

In addition to the jail term, Thane Additional Sessions Judge MC Khadke also fined accused Pintu alias Eizaz Shakir Ansari (24) with Rs 2000 for the offence punishable under section 326 of the IPC.

Additional Public Prosecutor Hemlata Deshmukh told the court that Pintu and victim Roshan Asrafali Shaikh (27) were residents of Gayatri Nagar. The accused used to pass lewd comments on Roshan’s wife which annoyed him. Despite repeated warnings to Pintu, he continued with the behaviour, the court was told.

On September 24, 2012 the accused reportedly asked one of their common friends Soyal to call out Roshan from his home in the night. Soyal took the victim to a place near a Darghah under the pretext of having a puff. Soon after, Pintu arrived on the scene and attacked Roshan with a knife but he escaped with grievous injuries on his hand.

Roshan was admitted to a private hospital following which Pintu was booked and arrested under section 307 of the IPC (attempt to murder).

The court after hearing both the prosecution and the defence held that the case fell under Section 326 (voluntarily causing grievous hurt by dangerous weapons or means) and not under 307. The evidence of the victim and his wife proved to be important in the case in addition to the testimony of the doctors who treated him.
