ಮಂಗಳೂರು, ಜನವರಿ 19 : ಕೋವಿಡ್ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ದಕ್ಷಿಣ ಕನ್ನಡ ಜಿಲ್ಲೆಯ ನೋಂದಾಯಿತ ರಿಕ್ರಿಯೇಶನ್ ಕ್ಲಬ್ ಮುಚ್ಚಲು ಜಿಲ್ಲಾಧಿಕಾರಿ ಆಗಸ್ಟ್ 18ರಂದು ಹೊರಡಿಸಿದ ಆದೇಶವನ್ನು ಮಾನ್ಯ ಹೈಕೋರ್ಟ್ ರದ್ಧುಪಡಿಸಿ ತೀರ್ಪು ನೀಡಿದೆ.
ಪ್ರಸ್ತುತ ಶಾಲಾ, ಕಾಲೇಜುಗಳು ಈಗಾಗಲೇ ತೆರೆಯಲ್ಪಟ್ಟಿವೆ ಮತ್ತು ಇಡೀ ಸಾರ್ವಜನಿಕ ಉದ್ಯಮಗಳು ಸುಗಮವಾಗಿ ನಡೆಯುತ್ತಿವೆ. ಆದ್ದರಿಂದ, ಜಿಲ್ಲಾಧಿಕಾರಿ ಜಾರಿಗೊಳಿಸಿದ ಸಂಬಂಧಪಟ್ಟ ಆದೇಶವನ್ನು ರದ್ದುಪಡಿಸಿ ಕರ್ನಾಟಕದ ಹೈಕೋರ್ಟ್ನ ವಿಭಾಗೀಯ ನ್ಯಾಯಪೀಠವು ತೀರ್ಪು ನೀಡಿ, ಮನರಂಜನಾ ಕ್ಲಬ್ಗಳನ್ನು ತೆರೆಯಲು ಅನುಮತಿ ನೀಡಿದೆ.
ಕೋವಿಡ್ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಮನರಂಜನಾ ಕ್ಲಬ್ಗಳನ್ನು ಮುಚ್ಚಲು ನಾಲ್ಕು ಅಂಶಗಳ ಆಧಾರದಲ್ಲಿ ಜಿಲ್ಲಾಧಿಕಾರಿ ನಿರ್ದೇಶನ ನೀಡಿದ್ದರು. ಅರ್ಜಿದಾರರ ಪರವಾಗಿ ನ್ಯಾಯವಾದಿ ರಾಜರಾಮ್ ಸೂರಂಬೈಲ್ ಅವರು ವಾದಿಸಿದ್ದರು.

Due to Covid-19 Pandemic decease.

In the instant case, the Respondent Deputy Commissioner, has passed the order dated 28.08.2020 that, the Registered Recreation Clubs in and around Dakshina Kannada district shall be closed. In fact, the Appellant Recreation Clubs have been running the clubs smoothly by obtaining license to carry on lawful activities in their own premises. At this juncture, the impugned direction and order passed by the Deputy Commissioner to close the Recreation Clubs for the reason that, if the Recreation Clubs open there may be chance of spreading chance pandemic decease. Hence, the Deputy Commissioner, had given some reasons for the said issue i.e.,
- There is no possibility of maintaining minimum one meter distance while playing cards in the Recreation Clubs.
- While playing the cards if any person is infected amongst the persons exchanging the cards, there is possibility of spreading the decease.
- Since the persons who are involved in playing the game, they have to play with concentration on the game, certainly there is possibility of having tension, angry and pressure. Since the persons who are participating in the Recreation Clubs are using of mask, Sanitizer very less and hence there is possibility of spreading the decease.
- Since there is no SOP of any type to Recreation Clubs , it cannot possible to control the members and it is very necessary to take action for stopping all the activities including the playing of cards in this Recreation Clubs till the control of Covid-19 pandemic.
On the above said reasons the Respondent Deputy Commissioner had directed to close the Recreation Clubs. Now the matter had been before Hon’ble Division Bench of Hon’ble High Court of Karnataka and the Hon’ble High Court of Karnataka specifically observed that at present the school and colleges are already opened and entire public entrepreneurs are smoothly running. Hence Hon’ble High Court has quashed the impugned order passed by the Deputy Commissioner dated 28.08.2020 and permitted to open the Recreation Clubs.
